Fynd App Terms of Use, Privacy Notice & Legal Policies

This document forms a legally binding agreement between you and Fynd. Please read it carefully before using the platform.


1. Introduction

Welcome to Fynd ("Fynd", "the App", "we", "our", or "us"), a hyper-local, verified South African marketplace platform that connects customers with nearby service providers, contractors, tradespeople, small businesses, and other independent local merchants, and that enables transactions to take place directly between users on the platform.


These Terms of Use, Privacy Notice, Cookies Policy, Disclaimers, and related legal policies (collectively, the "Terms") form a legally binding agreement between you and Fynd, and apply to all users of the App, including customers, service providers, sellers, buyers, and visitors.


By accessing, registering for, browsing, or using Fynd, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App or related services.


2. Eligibility

By using Fynd, you confirm that:

- You are at least 18 years old, or the age of majority in your jurisdiction, whichever is greater;

- You have the legal capacity to enter into binding agreements;

- All information you provide is true, accurate, current, and complete;

- You will keep your account information updated; and

- Your use of Fynd complies with all applicable laws and regulations in your jurisdiction.

We reserve the right to restrict, suspend, or refuse access where eligibility requirements are not met or cannot be verified

3. Nature of the Platform

Fynd is a marketplace and discovery platform for local businesses, independent service providers, and individuals offering goods or services. Fynd:

- Connects customers with independent third-party sellers and service providers;

- Facilitates discovery, communication, bookings, listings, and (where applicable) payment processing;

- Provides verification, ratings, and other trust-enhancing features; and

- Provides the infrastructure through which local transactions may be initiated, negotiated, and completed.


Fynd does not:

- Employ, represent, or act as agent for any service provider, seller, or business listed on the platform;

- Control, direct, or supervise how providers perform services, fulfil orders, or conduct their business;

- Take ownership of, inspect, or guarantee the condition, legality, or quality of any goods sold through the platform; or

- Guarantee service quality, safety, availability, pricing accuracy, or transaction outcomes.


All transactions, service engagements, and agreements are entered into directly between users (whether customers, sellers, providers, or businesses). Fynd acts solely as an intermediary technology platform and is not a party to any agreement concluded between users.


4. Accounts and Verification

Users may be required to create an account to access certain features of Fynd. You agree to:

- Provide accurate, current, and complete personal or business information;

- Maintain the confidentiality of your login credentials; and

- Accept full responsibility for all activity that occurs under your account.


Service providers, sellers, and local businesses will be required to complete a verification process, including submission of:

- Identity documentation;

- Proof of address;

- Business registration or trading information;

- Certifications, licences, or permits (where relevant to the goods or services offered); and

- Banking or payment details, where Fynd facilitates payments on the user's behalf.


Fynd reserves the right to:

- Approve, reject, or remove any listing, profile, or storefront;

- Request additional verification at any time;

- Suspend, restrict, or terminate accounts that fail verification, provide false information, or breach trust and safety standards.


Verification improves trust but does not constitute a guarantee of a user's reliability, honesty, safety, competence, solvency, or future conduct.


5. Listings, Orders, Bookings and Availability

Sellers and service providers are responsible for the accuracy of their own listings, including descriptions, pricing, stock availability, images, and service details. Fynd does not independently verify the accuracy of listing content unless expressly stated.


All orders and bookings are subject to:

- Provider or seller availability and stock levels;

- Geographic coverage and delivery or collection arrangements;

- Scheduling constraints; and

- Operational limitations of the relevant business.


Fynd and individual sellers or providers reserve the right to:

- Reschedule appointments or delivery/collection times;

- Decline or cancel orders and booking requests; and

- Cancel confirmed bookings or orders with reasonable notice where circumstances require.


We do not guarantee the immediate or continued availability of any provider, seller, product, or service.


6. Payments, Fees and Commissions

Sellers and service providers set their own prices, rates, call-out fees, and service terms. Customers and buyers engage providers and sellers entirely at their own discretion.


Where Fynd facilitates payments between users, whether for goods, services, or bookings:

- Any applicable fees, commissions, or service charges payable to Fynd will be clearly disclosed to users before a transaction is concluded;

- Payment processing may be carried out via third-party payment service providers, who operate subject to their own terms and privacy practices;

- Accepted payment methods will be communicated at checkout, booking, or invoice stage; and

- Funds may be held, released, or transferred between parties in accordance with Fynd's payment processing arrangements in place from time to time.


Unless otherwise agreed in writing, payment for goods is due at the point of order, and payment for services is due upon completion of the relevant service.


Failure to make payment when due may result in:

- Suspension of platform access;

- Referral to debt collection processes; and

- Additional administrative or late-payment fees, where legally permissible.


7. Cancellations, Returns and Refunds

Customers should provide at least 24 hours' notice for the cancellation of bookings or services, where reasonably possible.


Late cancellations or no-shows may result in:

- Cancellation fees;

- Call-out charges; and

- Partial or full loss of any deposit paid.


For goods purchased through the platform, return and refund eligibility is determined by the individual seller's stated policy, subject to applicable South African consumer protection law, including the Consumer Protection Act 68 of 2008 where it applies to the transaction.


Refund eligibility generally depends on:

- The type of goods or services involved;

- The relevant seller's or provider's stated policy; and

- The specific circumstances of the dispute.


Fynd may assist in facilitating disputes between users but does not guarantee, underwrite, or process refunds on behalf of sellers or providers unless expressly stated otherwise.


8. Quality of Goods and Services

Fynd encourages high-quality goods and service delivery from all businesses on the platform. However, we cannot guarantee:

- Customer satisfaction;

- Completion timelines for services or deliveries;

- Specific outcomes or results; or

- Workmanship, product quality, or condition beyond factors within the relevant seller's or provider's control.


Any issues relating to the quality of goods or services should be reported to the relevant seller or provider, and to Fynd where applicable, within 7 days of delivery or service completion.


9. User Conduct

You may not use Fynd to:

- Commit fraud or deception of any kind;

- Misrepresent your identity, qualifications, or the nature of your goods or services;

- Upload false, misleading, or fraudulent listings, reviews, or content;

- Harass, threaten, discriminate against, or abuse other users;

- Engage in unlawful activity, including the sale of prohibited, counterfeit, or stolen goods;

- Circumvent the platform in bad faith, including to avoid applicable fees; or

- Attempt to hack, scrape, reverse engineer, or otherwise disrupt the App or its systems.


Violations of this section may result in warnings, suspension, permanent bans, removal of listings or funds held in connection with the violation, and legal action where appropriate.


10. Reviews and Ratings

Users may submit ratings and reviews based only on genuine experiences with goods, services, or other users. Fynd reserves the right to remove, hide, or restrict content that is:

- Fraudulent or fake;

- Defamatory;

- Misleading;

- Abusive, discriminatory, or harassing; or

- Irrelevant or spam.


Reviews and ratings remain the personal opinions of the users who submit them and do not necessarily reflect the views of Fynd.


11. User Content

You may upload content to Fynd, including photos, reviews, listings, product descriptions, service descriptions, storefront information, and messages ("User Content").


You retain ownership of your User Content. By uploading User Content, you grant Fynd a worldwide, royalty-free, non-exclusive licence to use, reproduce, display, store, adapt, and process such content for the purposes of:

- Operating and providing platform functionality;

- Facilitating the delivery of goods and services between users;

- Trust, safety, and fraud-prevention measures; and

- Marketing and product improvement, excluding the use of sensitive personal information for such purposes without your consent.


You warrant that any User Content you upload is your own, or that you have the necessary rights to upload it, and that it does not infringe the intellectual property, privacy, or other rights of any third party.


12. Intellectual Property

All platform content, including branding, logos, trademarks, software, designs, databases, App architecture, and written content (excluding User Content), belongs to Fynd or its licensors and is protected under applicable intellectual property laws.


Without our prior written permission, you may not:

- Copy or reproduce any part of the platform;

- Resell or commercially exploit any platform content;

- Reverse engineer, decompile, or attempt to extract the source code of the App; or

- Use Fynd's branding, trademarks, or trade dress in a manner likely to cause confusion.


PRIVACY NOTICE (POPIA COMPLIANCE)

13. POPIA Compliance

Fynd is committed to protecting personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"), and, where applicable to users outside South Africa, in line with comparable international data protection standards.


By using Fynd, you consent to the collection, processing, storage, and lawful use of your personal information as described in this Privacy Notice.


14. Personal Information We Collect

All Users:

- Full name;

- Email address;

- Phone number;

- South African ID number, where required for verification;

- Location data (GPS or manually entered);

- Profile photos; and

- Device and usage information.


Service Providers, Sellers and Local Businesses:

- Business name and registration details;

- Listing, product, and service descriptions;

- Pricing and availability information;

- Banking and payment details;

- Verification documents; and

- Certifications, licences, or permits.


Customers and Buyers

- Service requests and orders;

- Preferences;

- Transaction and order history; and

- Ratings and reviews submitted.


15. Lawful Basis for Processing

We process personal information on the following lawful bases:

- Your consent;

- Contractual necessity, including to facilitate transactions between users;

- Compliance with legal obligations; and

- Our legitimate business interests, including fraud prevention, platform security, service optimisation, and trust and safety.


16. How We Use Personal Information

We use personal information to:

- Create and manage user accounts;

- Verify users, sellers, and service providers;

- Facilitate listings, orders, bookings, and transactions;

- Process payments between users where Fynd facilitates payment;

- Enable communication between users;

- Improve platform performance and functionality;

- Provide customer support;

- Prevent fraud and abuse; and

- Meet our legal and regulatory obligations.


We do not sell personal information. We do not knowingly use personal data for unsolicited direct marketing without your consent.


17. Disclosure of Personal Information

We may share limited personal information:

- Between transacting users (for example, sharing contact or delivery details between a buyer and seller) where necessary to complete a transaction;

- With payment processors and financial institutions to facilitate transactions;

- With verification or fraud-prevention partners;

- With legal authorities where required by law; and

- Where necessary to prevent fraud, abuse, or harm to any person or to the platform.


Any third-party processors engaged by Fynd are required to comply with applicable privacy laws, including POPIA where relevant.


18. Data Storage and Security

We implement reasonable technical and organisational safeguards, including:

- Encryption of data in transit and at rest, where appropriate;

- Secure servers and hosting infrastructure;

- Restricted access controls; and

- Regular monitoring and security audits.


No digital system is completely secure. By using Fynd, you acknowledge that data transmission over the internet carries inherent risk, and occurs at your own risk.


19. Retention of Information

We retain personal information only for as long as necessary for:

- Operating the platform;

- Compliance with legal and regulatory obligations;

- Fraud prevention;

- Recordkeeping; and

- Resolving disputes.


Thereafter, personal information may be deleted, anonymised, or archived in accordance with applicable law.


20. Your Rights Under POPIA

Subject to applicable law, you may:

- Request access to the personal information we hold about you;

- Request correction of inaccurate or outdated information;

- Request deletion of your information, where lawful to do so;

- Object to certain processing of your information; and

- Withdraw consent previously given, where processing is based on consent.


Such requests may be submitted through Fynd's official support channels and will be addressed in accordance with applicable law and our internal procedures.


21. Cross-Border Data Transfers

Personal information is primarily stored within South Africa. Where personal information is transferred to, or processed in, another country, Fynd will take reasonable steps to ensure that the recipient is subject to a level of data protection that is substantially similar to, and consistent with, the requirements of POPIA.


COOKIES POLICY

22. Cookies and Tracking Technologies

Fynd uses cookies and similar tracking technologies to improve platform functionality and the overall user experience. By continuing to use Fynd, you consent to our use of cookies, subject to your settings and applicable law.


Essential Cookies

Used for login sessions, security, transaction processing, and fraud prevention. These cookies are necessary for the platform to function and cannot be disabled.


Performance Cookies

Used for usage analytics, performance measurement, and error monitoring. Analytics data is anonymised where possible.


Preference Cookies

Used to remember your location preferences, saved settings, and service preferences.


Functional Cookies

Used to improve App functionality, user experience, and personalisation of content.


23. Managing Cookies

You may control cookies through:

- App settings;

- Browser settings; and

- Device permissions.


Please note that disabling certain cookies, particularly essential cookies, may impact the functionality of the platform and your ability to use certain features.


24. Third-Party Integrations

Fynd may, from time to time, integrate with third-party services for analytics, payments, mapping, messaging, identity verification, or other functions. These integrations may involve third-party cookies or data processing on terms set by those providers.


Fynd will take reasonable steps to ensure that any such third-party integrations comply with POPIA and other applicable privacy obligations.




DISCLAIMERS & LIABILITY

25. General Disclaimer

Fynd is provided on an "as is" and "as available" basis. We make no representations or warranties, express or implied, regarding:

- The availability, reliability, or continuous uptime of the platform;

- The accuracy or completeness of any listing, profile, or content;

- The conduct of any user, seller, or service provider; or

- The outcome of any transaction, order, or service.


Use of Fynd is entirely at your own risk.


26. Limitation of Liability

To the fullest extent permitted by law, Fynd shall not be liable for:

- Poor workmanship or defective goods;

- Service or delivery delays;

- Provider, seller, or buyer misconduct;

- Property damage;

- Financial loss;

- Personal injury; or

- Indirect, special, or consequential damages, including loss of profits, business, goodwill, or opportunity.


Where liability cannot be excluded by law, Fynd's total liability to you in connection with any transaction shall be limited to the lower of: the amount of any fees paid by you to Fynd in relation to that transaction, or the value of the relevant goods or services.


27. Safety Disclaimer

Although Fynd applies verification and trust measures, we do not guarantee:

- The honesty or integrity of any user, seller, or provider;

- The intentions of any other user;

- The safety of any in-person interaction, meeting, delivery, or service; or

- The accuracy of listings, credentials, certifications, or qualifications displayed on the platform.


Users must exercise reasonable caution and independent judgment at all times. We strongly encourage users to:

- Check reviews and ratings before transacting;

- Request quotations or written confirmation of pricing before committing to a service;

- Independently verify credentials for specialised or high-risk work; and

- Take normal, sensible safety precautions when meeting other users in person, including meeting in public or well-lit locations where appropriate.


28. Health and Safety

Customers and clients are responsible for ensuring that any premises where a service is to be performed are safe, accessible, and free from undisclosed hazards.


Clients must disclose to the relevant provider, in advance, any:

- Dangerous conditions on the premises;

- Structural hazards;

- Aggressive animals on the property; and

- Unsafe electrical, gas, or other utility conditions.


29. Indemnity

You agree to indemnify and hold Fynd, its directors, employees, and agents harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or in connection with:

- Your misuse of the platform;

- Your breach of these Terms;

- Disputes between you and any other user;

- Any illegal conduct on your part; or

- Any negligence or fraud committed by you.


30. Suspension and Termination

Fynd may suspend, restrict, or terminate any account at any time, with or without notice, for reasons including:

- Violations of these Terms or any applicable policy;

- Suspected fraud;

- Abuse (of any kind) of other users or the platform;

- Security risks; or

- Conduct that is harmful to the integrity of the platform or its community.


Termination may occur without prior notice where Fynd reasonably considers it necessary to protect users, third parties, or the platform itself.


31. Dispute Resolution

Users should first attempt to resolve any disputes between themselves through good-faith negotiation.


Where a dispute cannot be resolved between the parties:

- Applicable South African law shall apply; and

- Parties may pursue mediation, arbitration, or court proceedings, as appropriate to the nature of the dispute.


Fynd may, at its discretion, assist in facilitating the resolution of disputes between users, but is under no obligation to act as an adjudicator, mediator, or arbitrator of such disputes.


32. Changes to These Terms

We may amend these Terms from time to time, in our sole discretion, to reflect changes in our services, legal requirements, or operational practices. Updated versions will be published within the App and/or on the Fynd website, together with a revised "Last Updated" date.


Your continued use of the App after any such update constitutes your acceptance of the revised Terms. If you do not agree with any changes, you should stop using the App.


33. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Any legal disputes arising out of or in connection with these Terms or your use of Fynd shall be subject to the exclusive jurisdiction of the South African courts.
